Rules for using Fishing Weather
Terms of Service
These Terms govern your use of the Fishing Weather mobile applications, APIs, content, and related services.
Important: Fishing Weather provides informational forecasts and fishing tools. It is not an emergency, navigation, maritime-safety, or regulatory service. Always use official warnings, local regulations, and your own judgment.
1. Agreement to these Terms
These Terms of Service (“Terms”) are an agreement between you and the operator of Fishing Weather (“Fishing Weather,” “we,” “us,” or “our”). They apply to the Fishing Weather iOS and Android applications, related APIs, content, and websites (together, the “Service”).
By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind that organization.
2. Eligibility and accounts
You must be legally capable of entering into these Terms. If you are below the age of legal majority where you live, a parent or guardian must review and agree to these Terms and supervise your use.
You may use certain features without an account. Account features may require Sign in with Apple or Google. You are responsible for safeguarding your device and account access, providing accurate information, and notifying us promptly of suspected unauthorized access. You may not sell, transfer, or share an account in a way that compromises security.
3. The Service and important limitations
The Service may provide weather forecasts, marine conditions, tides, solunar information, fishing-condition scores, fish-species information, location search, saved places, catch records, and related tools. Availability and results vary by location, device, data provider, and network conditions.
- Forecasts, tides, fishing scores, and species information may be delayed, incomplete, estimated, or inaccurate.
- Fishing scores do not guarantee fish activity or a catch.
- Species text and images, including illustrative or AI-generated images where identified, are educational and are not a substitute for expert identification.
- The Service does not determine whether fishing is lawful at a location or time.
You are responsible for checking official weather and emergency alerts, maritime and navigation information, access rules, licenses, seasons, protected species, size and bag limits, and all other local requirements. Never rely on the Service as the sole basis for decisions affecting life, health, property, navigation, or legal compliance.
4. Your catch records and content
You retain ownership of photos, notes, custom species names, and other content you submit (“User Content”). You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, process, transmit, and display User Content back to you only as reasonably necessary to operate, secure, maintain, and support the Service.
You must have the rights and permissions needed to upload User Content. Do not submit unlawful, infringing, harmful, deceptive, or privacy-invasive material. Avoid uploading content that unnecessarily reveals another person’s identity, private location, or sensitive information without permission.
Catch records are private by default, but no online system is risk-free. Keep your login and device secure. You may delete individual records in the app.
5. Acceptable use
You may not:
- Use the Service unlawfully or to facilitate harm, harassment, fraud, poaching, trespass, or environmental damage.
- Access another person’s account or private content without authorization.
- Interfere with security, rate limits, availability, or normal operation of the Service.
- Upload malware or use automated systems to scrape, overload, or extract data except where we expressly permit it.
- Reverse engineer, copy, resell, or commercially exploit the Service except as permitted by law or written authorization.
- Misrepresent Service data as an official safety warning, legal determination, or guaranteed forecast.
6. Third-party services
The Service relies on third parties for sign-in, maps or place data, weather, marine and tide information, analytics, diagnostics, hosting, and app distribution. Their services and content may be governed by separate terms and privacy policies. We do not control their availability or independent practices.
Links to third-party services are provided for convenience and do not imply endorsement. Use third-party services at your own discretion.
7. Our content and license to you
The Service, excluding User Content and third-party material, including its software, design, text, databases, logos, and original content, is owned by or licensed to Fishing Weather and is protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for lawful, non-commercial purposes. No rights are granted except those expressly stated.
8. Changes, suspension, and termination
We may add, modify, suspend, or discontinue features to improve the Service, address security or legal requirements, respond to provider changes, or manage operations. We will provide notice where required. We do not guarantee that every feature will always be available.
You may stop using the Service at any time and may delete your account in the app. We may restrict or terminate access if you materially violate these Terms, create risk or harm, or if required by law.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.
We do not warrant the accuracy or timeliness of forecasts, tides, species identification, fishing scores, location results, or third-party data. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, Fishing Weather and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, missed fishing opportunities, injury, property damage, or losses arising from reliance on forecasts, tides, scores, species information, or location data.
Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law. These limitations do not apply where prohibited, including to liability that cannot legally be limited.
11. Applicable law and disputes
These Terms are governed by applicable law, without depriving you of mandatory consumer protections available where you live. Before starting formal proceedings, please contact us and give us a reasonable opportunity to resolve the issue. Nothing here limits your right to contact a regulator, consumer authority, or court where that right cannot be waived.
12. Changes to these Terms
We may update these Terms to reflect changes to the Service, providers, business practices, or law. We will post the revised Terms and update the date above. If a material change requires notice or consent, we will provide it as required. Continuing to use the Service after the effective date means you accept the updated Terms where permitted by law.
